Iraq-born man charged over alleged visa breaches in WA

An Iraq-born man is set to appear before Perth Magistrates Court today (12 February, 2026) charged for allegedly failing to comply with his visa-mandated conditions.  

The AFP charged the man, 43, yesterday (11 February, 2026) after he was located in Perth.  

It will be alleged the man breached a condition of his Commonwealth visa by failing to report to the Department of Home Affairs, as directed, multiple times between 10 December, 2026, and 4 February, 2026.

The man has been charged with seven counts of failing to comply with a requirement of his monitoring conditions, contrary to section 76B of the Migration Act 1958 (Cth).

The maximum penalty for this offence is five years’ imprisonment and/or a $99,000 fine.
