Somalia-born man, 31, charged with visa offences in Victoria

A Somalia-born man is set to appear before the Melbourne Magistrates’ Court today (12 February, 2026) charged with 15 offences related to allegedly failing to comply with his visa-mandated and bail conditions.  

The AFP charged the man after he was located in Melbourne yesterday (11 February, 2026).  

It will be alleged the man, 31, breached the conditions of his Commonwealth visa by not ensuring his monitoring device remained in good working order, and failing to comply with his curfew conditions.  

He has been charged with:

  • Three counts of failing to maintain electronic monitoring device, contrary to section 76D(3) of the Migration Act 1958 (Cth). This offence carries a maximum penalty of five years’ imprisonment and/or a $99,000 fine;
  • Two counts of failing to comply with visa curfew conditions, contrary to section 76C(1) of the Migration Act 1958 (Cth). This offence carries a maximum penalty of five years’ imprisonment and/or a $99,000 fine;
  • Five counts of committing an indictable offence whilst on bail, contrary to section 30B of the Bail Act 1977 (Vic). This offence carries a maximum penalty of three months’ imprisonment and/or a $9900 fine; and
  • Five counts of contravening a conduct condition of bail, contrary to section 49F of the Summary Offences Act 1966 (Vic). This offence carries a maximum penalty of three months’ imprisonment and/or a $9900 fine.
