Sydney man accused of breaching Control Order

A 25-year-old Sydney man is due to face Burwood Court today (16 December 2020) charged with allegedly breaching a Federal Court of Australia Control Order.

The AFP High Risk Terrorist Offenders (HRTO) team arrested the man at his residence in the Sydney suburb of Auburn this morning.

Police will allege the man failed to comply with a condition of the Control Order by causing another person to use a mobile telephone device on his behalf.

He has been charged with two counts of contravening a Federal Court of Australia Control Order, contrary to section 104.27 of the Criminal Code Act 1995 (Cth).

The offence carries a maximum penalty of five years imprisonment.

A Control Order was confirmed in relation to this individual in May 2020 and is in force until 27 February 2021.

The HRTO teams across Australia have to date arrested four people accused of breaching a Control Order since July 2020.

The AFP, NSW Police Force, ASIO and other partner agencies use Commonwealth and State legislative measures, including Control Orders, to ensure the ongoing safety of the Australian community.

No specific and impending threat to the community has been identified in relation to this matter.
